A BROKEN Hill man has pleaded not guilty to five offences related to allegedly throwing drugs over the wall of the Broken Hill Correctional Centre.
The 41-year-old man, who is in custody, appeared before the Broken Hill Local Court on Tuesday, April 15, via video link.
The drugs were allegedly thrown over the fence on Sunday, April 13.
Lawyer Rachel Storey began by outlining her long-term working relationship with the alleged offender and his history of homelessness which began at 11 years old following severe domestic violence in the family home.
The defence also stated that the man sustained head injuries from his time living rough as a child.
Ms Storey informed Magistrate John McIntosh and the prosecutor that there has been no brief served and that therefore she has no evidence to reference, and asked for a release request, which was opposed by the prosecutor.
The man is charged with entering a building/land with intention to commit an indictable offence, bringing a prohibited drug/plant into place of detention, supplying a prohibited drug, unlawfully delivering or attempting to deliver anything to an inmate, and entering enclosed land without a lawful excuse.
He has pleaded not guilty to all of these charges.
Before this incident he had served a recent period of incarceration, been on two intensive correction orders, one community corrections order, and parole for eight months.
His lawyer said he’d done well on the ICO.
Magistrate McIntosh said that the alleged offences are serious, and that since the man had been allegedly seen on CCTV throwing the drugs, believed to be methamphetamine, the case was a strong prosecution case.
Therefore Magistrate McIntosh said he is “too much of a danger to the community” and his bail was refused.
All matters are listed for mention on Tuesday, May 20 at the Broken Hill Local Court, with the brief served and defense instructed to reply by Tuesday, May 13.
