A BROKEN Hill man who was found guilty of stabbing his brother with a kitchen knife faced charges relating to possession and cultivation of a prohibited drug in local court on Monday.
Kyle Ross Henderson, who is awaiting sentencing after a jury found him guilty of intention to cause serious harm to his older brother in 2023, pled guilty to possession of 1.9 grams of cannabis leaf earlier this month.
His lawyer Toni Mudditt said Henderson had received a package through the fence of the correctional facility where he was being detained.
She said that the crime was “spontaneous” and “unsophisticated,” noting that as soon as the illicit substance was detected by staff Henderson was co-operative and pled guilty on the first occasion.
Magistrate Jacqueline Trad heard Henderson spent 11 days in segregation at the correctional facility as punishment.
Ms Trad said it was clear that the offence was unsophisticated “given how easily it was detected”.
“Drugs getting into a correction facility has significant consequences for the management and safety of the facility,” she said.
Henderson was convicted of possession but faced no additional penalty, and no action was imposed relating to the breach of his community corrections order.
“I determine that in relation to the community correction order, I’ll take no action on the breach in terms of possession of prohibited drugs, taking into account 11 days in segregation,” Ms Trad said.
“I record a conviction with no additional penalty.”
Henderson is currently in custody while he awaits sentencing relating to intentionally causing grievous bodily harm, which is expected to occur in December.
