A MAN has pled guilty in Broken Hill Local Court on Tuesday to common assault, with the court hearing that he had assaulted a security guard while under the influence of alcohol.
Magistrate McIntosh said the assault was uncalled for and uneccesary.
“The security guard is going about his work, your client is clearly intoxicated, is refused entry and says to the security guard ‘do you want to fight?’” McIntosh said.
“Grabs his shirt, pulls him to the ground and lands on top of him. A man going about his job shouldn’t have to put up with nonsense like this.”
The offender’s lawyer asked for leniency on the fine, considering he had expressed remorse and the assault was brief with no major injuries sustained.
The court heard the man did have a history of assault, but hadn’t offended for many years. He was found guilty of common assault and convicted for the offence, and given a $600 fine.
